These terms govern the use of the Sky platform (web) and the Sky by SkyFirstLabs mobile app (iOS and Android), together referred to as "Sky". Sky is provided by SPECIAL OPTION, LDA (brand SkyFirstLabs), NIPC 518824985, with its registered office at Estrada Nacional 4, Quinta Fernão Pote, caixa 3, 7350-422 Elvas, Portugal ("SkyFirstLabs", "we", "us").

The terms of use for the skyfirstlabs.com website are on a separate page.

1. Who these terms apply to

Sky is a service for businesses. It is subscribed to by an organisation (the "Customer") under a contract with SkyFirstLabs (the "Contract"). These terms apply to each person to whom the Customer gives access (the "User").

If the Customer's Contract says something different from these terms, the Contract prevails. Sky is not intended for consumers or for anyone under 16.

2. Account

  • The account is created by the organisation. There is no public sign-up. The Customer's administrator creates the accounts, sets the roles (for example, administrator or member) and decides who keeps access.
  • The administrator may suspend or remove your account at any time. Removal is carried out by the organisation. To request deletion of your account, speak to your administrator. See Account and data deletion.
  • You are responsible for keeping your credentials secure and for not sharing them. If you suspect unauthorised access, tell your administrator and support.
  • If the Customer's Contract ends, access for all of that Customer's Users also ends.

3. Acceptable use

When using Sky, you agree not to:

  1. access data, sources or workspaces for which your organisation has not given you permission;
  2. attempt to circumvent access controls, plan limits or security measures, or test for vulnerabilities without written authorisation from SkyFirstLabs;
  3. upload malware, unlawful content or content that infringes the rights of others, including copyright and personal data processed without a legal basis;
  4. use Sky to harass, discriminate against or deceive people, or to generate unlawful or offensive content;
  5. attempt to extract Sky's code, models or prompts, reverse engineer it, or resell the service without authorisation;
  6. overload the service with automated requests outside the interfaces provided.

We may suspend access that breaches these rules or puts the service or other Customers at risk. Where possible, we notify the Customer's administrator before doing so.

4. Content generated by artificial intelligence

  • Sky uses artificial intelligence models to answer questions, summarise data and run agents. Answers are generated automatically and may be wrong, incomplete or out of date, even when they cite the source.
  • Answers are a decision-support aid. They do not replace professional judgement and do not constitute legal, financial, medical or any other kind of advice. Check the information before using it in important decisions.
  • Report. If an answer is wrong, offensive or inappropriate, tap Report on the answer itself, or contact support. We review reports to fix defects and prevent abuse.
  • Customer data is not used to train models, whether ours or third parties'. See the Privacy Policy.

5. Customer Data

  • The data belongs to the Customer. The data the Customer connects or uploads to Sky, the questions, the answers and the results ("Customer Data") remain the Customer's. SkyFirstLabs acquires no rights over them. It uses them only to provide the service, in accordance with the Contract and the Data Processing Agreement (DPA).
  • Sky queries the Customer's data sources live and does not store the rows of that data. Access credentials are stored encrypted.
  • The Customer is responsible for having a legal basis for the data it connects to Sky and for configuring who can access it.
  • At the end of the Contract, Customer Data is deleted within the periods set out in the DPA.

6. Intellectual property

Sky (the software, the apps, the brand, the documentation and the configuration templates) belongs to SkyFirstLabs or its licensors. While the Contract is in force, we grant you a personal, non-exclusive and non-transferable licence to use Sky on behalf of the Customer.

If you send us suggestions, we may use them to improve the service, without any obligation to you.

7. Availability and changes

  • We make reasonable efforts to keep Sky available and secure. However, the service may be interrupted for maintenance, faults or causes beyond our control. Guaranteed service levels, where they exist, are set out in the Customer's Contract.
  • The app receives automatic updates. Some features depend on the plan subscribed to by the Customer.
  • We may change features. If a change materially reduces the contracted service, we notify the Customer in advance, in accordance with the Contract.

8. Liability

  • Sky is provided for professional use. To the maximum extent permitted by law, SkyFirstLabs is not liable to the User for indirect damage, loss of profits or loss of data resulting from decisions taken on the basis of answers generated by Sky.
  • SkyFirstLabs's liability to the Customer is governed by the Contract.
  • Nothing in these terms excludes liability that the law does not allow to be excluded, including in cases of wilful misconduct or gross negligence.

9. App stores

If you downloaded the app from the App Store, Apple is not a party to these terms, does not provide support for the app and is not responsible for it. Support is provided by SkyFirstLabs. The App Store or Google Play usage rules also apply, as the case may be. In the event of conflict, these terms prevail, to the extent the store allows.

10. Privacy

The processing of personal data is described in the Privacy Policy.

11. Changes to these terms

We may update these terms. The date at the top shows the latest version. If a change is material, we give reasonable advance notice, through the Customer or within the app.

12. Governing law and jurisdiction

These terms are governed by Portuguese law. Any dispute shall be subject to the courts of the district of Portalegre, to the exclusion of any other, unless mandatory legal provisions state otherwise.
